Terms & Conditions
Last Updated: September 2026
These Terms and Conditions (“Terms”) govern the design services provided by Selective Design (“Selective Designs,” "I," “we,” “us,” or “our”). By requesting, purchasing, or engaging our services, you acknowledge that you have read, understood, and agreed to these Terms.
1. Definitions
Client: Any individual, family representative, business, organization, or other party engaging Selective Design for design services.
Services: Graphic design and related creative services provided by Selective Design, including obituary and memorial design and select custom design services.
Design: The creative work produced by Selective Design based on information, images, instructions, and materials provided by the Client.
2. Scope of Services
Services will be based on the information the Client provides and the service selected.
For larger or custom projects, the scope of work, pricing, timeline, and deliverables may be outlined in a written estimate, proposal, invoice, or other agreement.
Selective Design reserves the right to decline projects that fall outside the services currently offered.
All services are for design only. Printing is not offered or included.
3. Pricing & Quotes
Prices listed on the Services & Price Guide represent starting or standard rates and may vary depending on the complexity, size, number of pages, turnaround time, and specific requirements of a project.
Custom projects will be quoted individually.
Quotes and estimates are subject to change if the Client requests changes that substantially alter the original scope of work. We will communicate any additional charges to the Client before completing the additional work.
4. Payments
We will communicate payment arrangements at the beginning of each project.
Depending on the service, we may request payment before work begins or invoice upon completion.
Do not submit payment for a design until the design has been approved for completion when payment is being requested upon completion.
A project is not considered complete until the applicable balance has been paid.
Selective Designs may pause work or withhold final deliverables when an outstanding balance remains unpaid.
5. Client-Provided Information & Materials
The Client is responsible for providing accurate, complete information, including names, dates, photographs, written content, and other materials needed to complete the project.
For obituary and memorial designs, the Client or designated family representative must verify all names, dates, relationships, service information, photographs, and other personal information before final approval.
Selective Designs is not responsible for errors resulting from incorrect, incomplete, or outdated information the Client supplies.
The Client confirms that they have permission to provide and use any photographs, written content, logos, or other materials submitted for the project.
6. Revisions & Approvals
The number of revisions included in a project may vary by service and will be communicated when applicable.
Revisions are intended to correct or adjust the approved design direction. Significant changes to the original concept, layout, or scope may result in additional charges.
The Client is responsible for carefully reviewing the design before providing final approval.
Once the Client approves a design, the Client accepts responsibility for the accuracy of the approved content.
Changes requested after final approval may be subject to an additional fee.
7. Obituary & Memorial Services
Because obituary and memorial projects are often completed under time-sensitive circumstances, Clients are encouraged to submit all available information, photographs, and preferences as early as possible.
Turnaround times depend on the completeness of the information provided, the design's complexity, the number of revisions, and the Client's responsiveness.
A designated family member or representative may communicate with Selective Designs on the family's behalf. Selective Designs will rely on the designated representative's instructions and approval.
Selective Design does not independently verify family, biographical, service, or genealogical information provided by the Client.
8. Turnaround & Delivery
We will communicate estimated completion times based on the needs of the individual project.
Turnaround begins once we receive the required information, photographs, and other materials.
Client delays in providing information, responding to revisions, or approving designs may affect the completion date.
We will deliver final digital files electronically unless otherwise agreed.
9. Ownership & Copyright
Upon receipt of full payment, the Client receives the right to use the final completed design for its intended personal or business purpose.
Selective Design retains ownership of its original design concepts, creative processes, templates, and other proprietary design elements unless otherwise agreed upon in writing.
Third-party fonts, graphics, photographs, or other licensed elements remain subject to their respective licensing terms.
Selective Design may display completed work in its portfolio, website, social media, or promotional materials unless the Client requests otherwise.
10. Cancellations & Refunds
Because design services are customized to each Client, payments for completed work are non-refundable.
If a project is canceled before completion, the Client may be responsible for payment for work completed up to the date of cancellation.
Once a design has been approved and finalized, no refunds will be issued for dissatisfaction resulting from information, content, photographs, or design direction the Client previously approved.
11. Errors & Corrections
Selective Design will make reasonable efforts to identify and correct design errors attributable to our work when the Client brings them to our attention before final approval.
If an error is identified after final approval and Selective Design caused it, we will take reasonable corrective action.
Selective Design is not responsible for errors contained in information supplied or approved by the Client.
12. Limitation of Liability
Selective Design is not responsible for delays or losses resulting from circumstances beyond our reasonable control, including Client delays, incomplete information, technical difficulties, equipment failure, internet interruptions, or other unforeseen circumstances.
Because Selective Design does not provide printing services, we are not responsible for printing, production, shipping, or print-quality issues associated with files the Client provides or submits to a third-party printer.
13. Confidentiality
Selective Designs respects the privacy of Client information and will make reasonable efforts to keep private information confidential.
Selective Design will not knowingly share Client information outside the scope of the project except when necessary to complete the requested service, required by law, or otherwise authorized by the Client.
14. Changes to These Terms
Selective Design reserves the right to update these Terms as services, policies, or business practices change.
The version of the Terms in effect when a project is accepted will generally apply to that project.
15. Contact
Direct questions about these Terms or Selective Design services through the contact information provided on the Selective Design website.
By engaging Selective Design, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
